Court to SCO: suck it!

Court Rules: Novell owns the UNIX and UnixWare copyrights! Novell has right to waive!: Hot off the presses: Judge Dale Kimball has issued a 102-page ruling [PDF] on the numerous summary judgment motions in SCO v. Novell. Here is what matters most:

[T]he court concludes that Novell is the owner of the UNIX and UnixWare Copyrights.

That's Aaaaall, Folks! The court also ruled that "SCO is obligated to recognize Novell's waiver of SCO's claims against IBM and Sequent". That's the ball game. There are a couple of loose ends, but the big picture is, SCO lost. Oh, and it owes Novell a lot of money from the Microsoft and Sun licenses.

wow, its only taken 4 years for the courts to decide what we knew was going to happen in 2003. At least they got it right. This is the beginning of the end of SCO. They now Novell more money than what their company is worth!

I've been using Ubuntu as my primary OS for almost a year now and have been loving it. I've been using the beta of Dapper Drake on a test box at work for quite some time now and have had zero problems. I look forward to upgrading my boxen at home.

Imagine being able to upgrade from XP to Vista by just using a program that downloads the files and upgrades your system for free. With Ubuntu, I can. :)

its nice to see all of SCO's yelling and arm waving finally getting them nowhere. Darl once said "I've been pounding the table here for a year or so saying there's no free lunch...." and SCO is finding out the hard way that there is no free money in Linux for them either.

Microsoft Calls AdTI "Study" an "Unhelpful Distraction": Well, friends, we've won the Alexis de Tocqueville FUD war. It's official. In the face of a united community's repudiation of Ken Brown's "Samizdat" attack on Linus and Linux, Microsoft told the Wall St. Journal's reporter, Lee Gomes, the report wasn't helpful, leading Gomes to end his report, "Recent attacks on Linux come from dubious source", like this:

"With growing numbers of businesses turning to Linux, its pros and cons are fair game for debate. But cynically manufacturing confusion isn't debating. Even Microsoft didn't like the way this report turned out, though it indirectly helped subsidize it. A company spokesman called the study, 'an unhelpful distraction from what matters most -- providing the best technology for our customers.'"

That is the cherry on top that dooms the report to the junk bin. I doubt that it enhances a "think tank's" reputation to be called an "unhelpful" "dubious source".

a little background: a guy named Ken Brown wrote a book claiming that there was no way Linus could have written Linux by himself back in 1991 and has interviews with many reputable sources. The problem is that he uses quotes out of context, doesn't understand what he's talking about, and basically states things that are not true. All of the people he interviewed have rebutted his assertions in public in one form or another. it makes you wonder what this guys motivation is if even the evil empire itself is not agreeing with this.

SCO is either lying through their teeth, on drugs, or just so stupid that they don't understand what their really doing. I see this as just a big pump and dump scheme to keep their name in the news and their stock price high so their investors can drop all their stock slowly over time and not get caught by the SEC. The insider trading that's been going on there is pretty interesting.

As far as this letter to congress goes, they misrepresent so many things that it makes you wonder if they truly understand Linux and Open Source at all. Oh well, a few more more months and SCO will be off the radar for good.

"we just got unix copyrights, now gimme money or i'll sue you!" i just love how sco uses vague language to try to scare people into giving them money. they haven't disclosed any kind of conclusive proof to their claims, gone to court, or won a law suit that would merit this kind of extortion. even if by some freak miracle sco did win its case against ibm, it still has no bearing on whether or not people have to pay sco to use linux. the case is about contract law, not IP law. someday maybe sco will take some of the $$ it got from microsoft and go buy a clue instead of trying to scare the linux community into giving up its lunch money.
